Gunn Law Group, P.A. Motto
  • Serving Florida Since 2005

Tampa Personal Injury Lawyer

Every year, thousands of people across the Tampa Bay area suffer injuries that were not their fault. A driver runs a red light on Dale Mabry Highway. A property owner ignores a known hazard at a Channelside warehouse. A manufacturer ships a defective product that ends up in someone’s hands at the worst possible moment. When negligence causes real physical harm, the person left holding the medical bills, the lost paychecks, and the sleepless nights deserves real legal representation, not a form letter and a lowball settlement offer. That is the reality that a Tampa personal injury lawyer at Gunn Law Group, P.A. prepares for every single day.

Florida’s personal injury system is built around the concept of negligence: one party failed to exercise reasonable care, and that failure directly caused another person’s harm. But understanding that principle in the abstract and proving it in practice are two entirely different things. Insurance companies in Florida have teams of adjusters, defense attorneys, and medical reviewers whose job is to find reasons to pay less, or nothing at all. The difference between a claim that settles for policy limits and one that gets discarded comes down to how it is built, documented, investigated, and ultimately presented to an insurer or a jury.

Tampa sits at a confluence of busy interstate corridors, a major port, a dense urban core, and some of the state’s most heavily trafficked tourist and commercial zones. I-275, I-4, US-19, and the Gandy and Howard Frankland bridges see enormous daily vehicle volumes. Hillsborough County courts regularly handle personal injury cases of genuine complexity, and the defense bar in this market is experienced and well-funded. None of that favors someone trying to navigate a serious injury claim without counsel. Gunn Law Group, P.A. was built specifically to tilt that equation back toward the people who actually got hurt.

The Full Scope of Personal Injury Claims Handled in Tampa

  • Motor Vehicle Accidents: Crashes on I-275 through downtown Tampa, on US-41 through Brandon, and across the Courtney Campbell Causeway produce some of the region’s most serious injury claims, including traumatic brain injuries, spinal injuries, and multiple-fracture cases involving rideshare vehicles, commercial trucks, and motorcycles.
  • Premises Liability: Property owners in Florida have a legal duty to maintain reasonably safe conditions for invitees and licensees. Slip and falls in Ybor City entertainment venues, staircase collapses in aging apartment complexes, and inadequate security at parking structures near Raymond James Stadium all fall under this category.
  • Trucking and Commercial Vehicle Accidents: The Port of Tampa and the interstate freight corridors running through Hillsborough County generate heavy commercial traffic. Crashes involving tractor-trailers typically involve multiple defendants, including the driver, carrier, loading company, and sometimes vehicle manufacturers, and the injuries tend to be catastrophic.
  • Defective Products: When a product is designed or manufactured in a way that makes it unreasonably dangerous, Florida law allows injured consumers to hold manufacturers and distributors accountable, covering everything from defective auto parts to unsafe consumer goods sold at retailers throughout the Tampa metro area.
  • Wrongful Death: When negligence causes a fatality, Florida law permits surviving family members to bring a wrongful death claim. These cases can arise from car accidents, medical negligence, workplace incidents, or any other situation where a death could have been prevented by the exercise of reasonable care.
  • Brain and Catastrophic Injuries: Gunn Law Group, P.A. handles cases involving traumatic brain injuries, spinal cord damage, severe burns, and other life-altering harm. These claims require a fundamentally different approach than routine injury cases, including long-term care cost projections, vocational expert testimony, and life planning analysis.
  • Negligent Security: Businesses and property owners who fail to provide adequate lighting, functioning locks, or appropriate security personnel can be held liable when criminal acts on their property injure guests or visitors, a recurring issue in certain commercial corridors around Tampa Bay.

Why Gunn Law Group, P.A. Takes Personal Injury Seriously in Hillsborough County

Gunn Law Group, P.A. brings more than 75 years of combined legal experience to personal injury and catastrophic injury cases across Florida. That depth of experience matters in a market like Tampa, where defense attorneys frequently test the patience and preparation of opposing counsel. The firm has secured millions of dollars in compensation for clients, with documented results including settlements and verdicts at and above the $10 million mark in serious injury and medical negligence cases. That track record communicates something important to insurance companies and defense firms: this is a firm that prepares cases for trial and does not simply wait for the first reasonable offer.

The firm’s focus is deliberately narrow. Gunn Law Group, P.A. concentrates on medical malpractice, catastrophic personal injury, and insurance bad faith, meaning every resource and every attorney at the firm is focused on the types of cases where the stakes are highest and the opposition is best-funded. Clients are not handed off to junior associates or treated as line items. The firm operates on a contingency basis, which means clients pay nothing unless compensation is recovered. That policy reflects not just a business model, but a genuine commitment to making serious legal representation available to people who are dealing with physical and financial hardship at the same time.

Gunn Law Group, P.A. has built its reputation in part by refusing to be intimidated by large insurers or healthcare institutions. The firm openly positions itself as willing to take cases to verdict when insurers fail to act in good faith. In the Tampa market, where carriers are well aware of which firms actually try cases and which ones settle quickly, that posture changes how negotiations unfold from the very beginning of a claim.

What to Actually Do After a Serious Injury in Tampa

The period immediately following a serious accident is chaotic, and the decisions made in those first days can materially affect the value and viability of a claim. Florida requires that crash reports be filed with law enforcement when an accident involves injury, death, or significant property damage. If the incident occurred on a Tampa city street, Tampa Police Department will typically respond and generate a report. Hillsborough County Sheriff’s Office handles incidents in unincorporated areas. Requesting a copy of that official report as soon as it becomes available gives you a baseline document that establishes the time, location, and initial account of what happened.

Medical treatment should not wait on legal strategy. Emergency care at Tampa General Hospital, St. Joseph’s Hospital, or AdventHealth Tampa creates the medical record that ultimately becomes the backbone of any injury claim. Gaps in treatment are consistently used by defense attorneys and insurance adjusters to argue that injuries were not serious, or that they were caused by something other than the accident in question. Following through on every recommended appointment, referral, and diagnostic test matters, not just for your health but for the integrity of the claim.

Florida’s statute of limitations for personal injury cases sets a firm deadline for filing suit. Missing that deadline typically forecloses the claim entirely, regardless of how clear-cut the liability evidence is. This is why waiting months before speaking with a Tampa personal injury attorney can be genuinely costly. Evidence disappears: surveillance footage gets overwritten, witnesses move or forget details, and physical conditions at the scene change. Engaging counsel early allows for prompt investigation, evidence preservation letters to defendants and third parties, and proper claim notification to all potentially liable parties.

Do not give recorded statements to the opposing party’s insurance carrier before speaking with an attorney. Adjusters are trained to ask questions in ways that elicit statements that can later be used to reduce or deny claims. Florida operates under a comparative fault framework, meaning that any percentage of fault attributed to you reduces your recovery proportionally. Statements that suggest you share some responsibility, even partially, can shift that calculation significantly. The Hillsborough County Circuit Court, located at the courthouse complex on Pierce Street in downtown Tampa, is where personal injury lawsuits are filed when resolution cannot be achieved through negotiation. Understanding that this is the endpoint of a failed negotiation, not a starting point, is part of how strong counsel approaches settlement leverage.

How Insurance Companies Handle Tampa Injury Claims and What That Means for You

Florida’s insurance environment creates specific dynamics that anyone pursuing an injury claim in Tampa needs to understand. The state’s no-fault system requires drivers to carry personal injury protection coverage, which pays a portion of medical expenses and lost wages regardless of fault, up to the policy limit. But PIP coverage has strict requirements, including a 14-day window to seek initial medical treatment after an accident. Missing that window can eliminate access to those benefits entirely.

Once PIP limits are exhausted or when injuries meet the threshold of permanence under Florida law, a claim against the at-fault party’s liability insurance becomes the vehicle for full compensation. This is where disputes tend to become serious. Liability carriers in Florida regularly dispute causation (arguing the injury predated the accident), extent of injury (challenging the medical testimony about severity), and the reasonableness of treatment costs (using independent medical examiners who reliably minimize findings). Gunn Law Group, P.A. handles insurance bad faith claims specifically, which means the firm understands insurer tactics not just from the outside but from the strategic level.

Uninsured and underinsured motorist coverage also plays a critical role in many Tampa injury claims. With a meaningful percentage of Florida drivers either uninsured or carrying minimum limits, victims with serious injuries often find that the at-fault driver’s policy is wholly inadequate. UM/UIM coverage on the injured party’s own policy can bridge that gap, but carriers often fight those claims aggressively as well. A Tampa injury attorney who understands how to handle first-party UM disputes is a different kind of advocate than one who only deals with straightforward third-party liability claims.

Questions Tampa Injury Clients Actually Ask

How long does a personal injury case typically take to resolve in Hillsborough County?

The timeline varies widely based on the severity of injuries, the complexity of liability, and the willingness of the opposing insurer to negotiate reasonably. Cases involving clear liability and fully healed injuries can sometimes resolve in a matter of months. Cases with catastrophic injuries, disputed fault, or multiple defendants can take considerably longer, particularly if they proceed to litigation in Hillsborough County Circuit Court. One factor that genuinely affects timelines is whether the plaintiff has reached maximum medical improvement, meaning treatment has concluded or stabilized. Settling before that point can undervalue future care costs significantly.

Florida uses a comparative fault system. What does that mean for my recovery?

Florida follows a modified comparative fault rule, meaning that if you are found to share some percentage of responsibility for the accident, your total recovery is reduced by that percentage. However, if a court determines you are more than 50 percent at fault, you are barred from recovering compensation entirely under current Florida law. This makes the factual investigation and liability narrative built by your attorney critically important, particularly in accidents where the other side is attempting to shift blame.

What compensation can actually be recovered in a Florida personal injury case?

Recoverable damages typically include past and future medical expenses, lost earnings and diminished earning capacity, physical pain and suffering, emotional distress, and loss of enjoyment of life. In cases involving extreme recklessness or intentional misconduct, punitive damages may also be available. For wrongful death claims, Florida law specifies which survivors can recover and what categories of loss are compensable. The full picture of what a case is worth requires analysis of medical records, employment history, expert testimony about future care costs, and sometimes vocational and economic expert input.

The at-fault driver had minimal insurance. Is my claim worth pursuing?

Potentially, yes, especially if you carry uninsured or underinsured motorist coverage on your own auto policy, or if another party shares liability (such as a vehicle manufacturer, a road maintenance authority, or a commercial entity). In some crashes, multiple defendants contributed to the harm, and identifying all of them is part of the early investigation process. Cases are not always limited to the most obvious defendant, and thorough investigation sometimes reveals liability sources that were not immediately apparent.

Can I still recover compensation if I did not go to the emergency room immediately after the accident?

A gap between the accident and initial treatment creates a challenge, but it does not automatically end a claim. Insurance adjusters will use that gap to argue the injury is not serious or was not caused by the accident. With the right medical documentation explaining the delay and evidence connecting the injury to the incident, claims with delayed treatment starts have been successfully resolved. That said, seeking evaluation promptly after any accident involving physical symptoms is always in the client’s best interest.

What happens if the injury happened on a government-owned property or involved a government vehicle in Tampa?

Claims against Florida government entities, including the City of Tampa, Hillsborough County, or state agencies, involve specific procedural requirements that differ from standard civil claims. Florida law requires pre-suit notice to the appropriate governmental body within a defined window, and the process before filing suit is distinct from typical injury litigation. Missing those notice requirements can eliminate the claim. This is one of the reasons why speaking with counsel promptly after an incident on public property or involving a government vehicle is particularly important.

How does Gunn Law Group, P.A. handle cases on a contingency basis?

The firm does not charge attorney’s fees unless compensation is recovered. Costs advanced during litigation, such as expert witness fees, filing fees, and investigation expenses, are also typically recouped from the settlement or verdict. This structure means that access to aggressive, well-resourced legal representation is not gated by whether the client can write a check on day one. The financial risk of pursuing the claim rests with the firm, not the injured person.

What if the at-fault party’s insurer makes a quick settlement offer right after the accident?

Early settlement offers from the opposing carrier are nearly always designed to resolve the claim before the full extent of injury is known. An offer made in the first days or weeks after a serious accident rarely, if ever, accounts for future surgery, long-term rehabilitation, lasting disability, or the non-economic impact of a permanent injury. Accepting a settlement releases all future claims arising from the incident, meaning there is no going back if your condition turns out to be more serious than initially understood. Having a Tampa personal injury attorney evaluate any offer before you respond is one of the most practically important steps you can take.

Do personal injury cases in Florida always go to trial?

The substantial majority of personal injury cases are resolved through negotiation before trial. But the negotiation outcome is heavily influenced by whether the opposing party believes the plaintiff’s attorney is genuinely prepared to try the case. Firms that routinely settle every case without ever taking one to verdict are known in the insurance industry, and their clients often receive lower offers as a result. Gunn Law Group, P.A. has a litigation posture, not just a settlement posture, and that distinction shapes how the firm approaches every file from the beginning.

What if my injury does not seem serious at first but worsens over time?

This is one of the most consequential situations in personal injury claims. Some injuries, including certain traumatic brain injuries, disc herniations, and soft tissue damage, present with manageable symptoms initially but worsen significantly over the following weeks or months. This is a strong argument for not rushing to settle early, and for maintaining consistent medical documentation throughout your recovery. If you have already spoken with an insurer without counsel, it is still worth consulting an attorney before signing anything or making further statements.

What is Personal Injury?

Personal injury refers to any physical, mental, or emotional harm caused to an individual as a result of someone else's negligence or intentional actions. Personal injury law allows individuals who have suffered injuries to seek compensation for their losses, including medical expenses, lost wages, pain and suffering, and other damages.

Here are several common types of legal theories for personal injury claims:

  • Negligence: Negligence is perhaps the most common theory in personal injury cases. It involves proving that the defendant owed a duty of care to the plaintiff, the defendant breached that duty, the breach caused the plaintiff's injuries, and the plaintiff suffered damages as a result.
  • Strict Liability: Strict liability holds a defendant responsible for harm caused by their actions regardless of fault or intent. This theory is often applied in cases involving defective products or inherently dangerous activities.
  • Intentional Torts: Intentional torts involve harm caused by deliberate actions of the defendant. Examples include assault, battery, false imprisonment, and intentional infliction of emotional distress.
  • Premises Liability: Premises liability holds property owners responsible for injuries that occur on their premises due to dangerous conditions. This can include slip and fall accidents, inadequate security leading to assaults, or injuries caused by unsafe conditions.
  • Product Liability: Product liability laws hold manufacturers, distributors, and sellers liable for injuries caused by defective products. This can include defects in design, manufacturing defects, or failure to provide adequate warnings or instructions.
  • Medical Malpractice: Medical malpractice occurs when healthcare professionals fail to provide a standard level of care, resulting in injury or harm to the patient. This can include surgical errors, misdiagnosis, medication errors, and other forms of medical negligence.
  • Wrongful Death: Wrongful death claims arise when a person dies due to the negligence or intentional actions of another party. Surviving family members may seek compensation for the loss of their loved one's financial support, companionship, and other damages.
How Long Do I Have to File a Personal Injury Case in Florida?

A statute of limitations is a legal rule that allows you to file a personal injury claim against a defendant that caused your accidents as long as the statute stands. When the statute expires, future claims will be thrown out by the court, except for extremely rare cases.

According to the Florida Statutes section 95.11(3)(a), Florida has a moderate statute of limitations for personal injury claims at two years, starting on the date of the accident or when your injuries were diagnosed or reasonably should have become noticeable. This means that you have two years from the date of your accident to file a personal injury claim or you will lose your right to do so along with your right to recover compensation.

As stated above, there are some rare circumstances in which the two-year time window can be changed. These exceptions are listed in Florida Statutes section 95.051 and include circumstances where:

  • The injured party is deemed legally incapacitated at the time of the accident
  • The alleged negligent party left the state of Florida before a lawsuit could be filed
  • The alleged negligent party intentionally concealed their identity to avoid a lawsuit

Additionally, if your injury claim is against a government entity or employee a formal notice must be sent within three years of the date of the accident and a lawsuit can only be filed after a 180-day investigation period. An attorney from our firm can help you navigate this complex area of personal injury law. Want to learn more about your rights and options? How Much Is My Personal Injury Case Worth?

A personal injury claim’s worth depends on many, many factors, so it can be difficult to predict its value upfront. What one claimant gets for a serious injury case could look much different than your settlement or award, even though the circumstances of the case seem similar.

Examples of factors that can change the value of a personal injury claim include:

  • Your age and overall health prior to the injury
  • Extent and permanency of your injuries
  • Your income and income capacity before you were injured
  • Your liability for your accident or injuries
How Much Does a Personal Injury Lawyer Cost?

When you work with Gunn Law Group in Tampa for your personal injury claim, you don’t need to stress about the cost of hiring legal help thanks to our contingency fees. Under a contingency fee agreement, we agree to work on your case and represent you at no initial cost.

We only get paid attorney fees if we end your case with a successful verdict, settlement, or award for you. Also, our fees are based on a percentage of your winnings – usually between 25% and 40% - so that you never have to pay more than what you can afford. Lastly, a court might order the defendant to pay our attorney fees as additional damage, meaning you effectively keep your full recovery.

What Is Breach of Duty?

Breach of duty occurs when a person’s actions or conduct do not meet a reasonable standard of care. Individuals are expected to act with reasonable care so as to avoid causing injury to another person.

What is considered a breach of duty? Below are some common examples of breached duty:

  • An individual texting while driving
  • An individual speeding
  • A landlord failing to treat a bed bug problem
  • A store owner failing to take care of slippery floors
  • A property owner failing to repair a broken step

When an individual fails to adhere to the duty of care, they can be proven negligent in an injury case. However, breach of duty is only one of the four elements used to determine negligence in a personal injury case. The other three factors are as follows: (1) an individual was owed the duty of care, (2) the breach of duty caused the individual harm, and (3) the individual suffered damages.
