Sulzer National Settlement

With over a thousand pending cases against its defective product, Sulzer recently proposed a national settlement plan designed to force all potential plaintiffs into the settlement, even if they believe their injuries are worth far more than the pact calls for. Under the proposed deal, patients who had two or more surgeries to replace their implants would receive $97,500, plus medical costs. Patients who had a single operation would get $57,500 plus medical costs, and persons who didn't require additional surgery would receive $2,750. The payments would be two-thirds in cash and one-third in Sulzer stock. The proposed agreement also gives all participants in the settlement a lien on Sulzer's assets. This would give participants under the national settlement a priority on liabilities - including court awards - over other plaintiffs who decide not to join the national settlement.
