2006

Miller v. Columbus McKinnon, et al: Products Liability. March 2006. State Court. Pre-Trial Settlement $1.2 million.

Plaintiff suffered right foot crushing injuries and ultimate partial amputation when 2000 pound mold fell out of hoist system during mold change-out operation on brick paver manufacturing machine. Strict liability and negligent design claims were brought against manufacturer of paver plant machine, mold manufacturer, hoist & hook manufacturer, and hoist supplier.

Silva v. Casa Herrera, et al: Products Liability. February 2006. State Court. Pre-Trial Settlement $1.5 million.

Plaintiff suffered digit amputation and crushing injuries to left hand as a result of unexpected start up and entrapment of hand in rotating gears of tortilla chip manufacturing machine. Strict liability and negligence claims were brought against machine manufacturer for defective design, and claims based in intentional tort were brought against Plaintiff's employer for failure to train, failure to warn, failure to implement lock/out tag/out protocols, among other willful conduct.

2005

Doe v. Owner: Auto Negligence - September 2005. State Court. Pre-trial Settlement: $850,000.

Unrestrained passenger sued the owner for the driver's negligence resulting in serious internal injuries and closed head trauma. Trial Attorney, Lee D. Gunn IV.

Doe v. Hospital & Doctors: Medical Malpractice - August 2005. State Court. Pre-Trial Settlement: $1.675 Million.

Ms. Doe sustained a post-operative infection. She asserted a delay and improper treatment that resulted in multi-organ failure with coma. The providers asserted that the infection was an acceptable complication and the care that followed saved the patient's life. Trial Attorney, Lee D. Gunn IV.

Estate of Kathryn Collins v. Cone Constructors, Inc., et al.
April 2005
13th Judicial Circuit, Hillsborough County
Pre-Trial Settlement, $2 million.

Kathryn Collins was struck and killed by a loaded dump truck while proceeding across a dirt haul road controlled by traffic signal. Witnesses identified Ms. Collins as having run the red light. Cone Constructors had installed a temporary signal in order to control traffic on the public road and the temporary dirt haul road. The Estate sued Cone and the various parties responsible for supervising the contractors' activities asserting negligent design and operation of the intersection that created driver confusion with other drivers reported to have frequently "run the red light" on prior days. The action against the dump truck driver, owner, and employer remains pending for failure to avoid the collision. Trial Attorney, Lee D. Gunn IV

Mr. & Mrs. Doe v. Manufacturer: Products Liability - March 2005. Federal Court: Pre-Trial Settlement $1.8 million.

Mr. Doe was rendered an incomplete quadriplegic after an alleged unexpected enagagement and fall off an embankment after restart of a self-propelled lawnmower. The case was set for trial in a state that follows pure contributory negligence. The manufacturer asserted the user operated the mower too close to the embankment causing the fall and subsequent injury. The matter settled for $1.8 million.

Doe v. Hospital & Doctors: Medical Malpractice - February 2005. State Court. Pre-Trial Settlement $850,000.

Mrs. Doe was discharged with a retained foreign body that was not noted despite its presence on X-Ray. She required a colostomy and a successful reversal with resultant short bowel syndrome. The matter settled for $850,000. Trial Attorney, Lee D. Gunn IV.

Seyer v. Withlacoochee Electric Cooperative, Inc. - January 2005
6th Judical Circuit, Pasco County.
Jury Verdict: $3 million.


Thirty five year old graphic sign artist was fatally electrocuted when he contacted a utility pole guy wire anchored to the ground. The guy wire was caused to be electrified as a result of too much slack in the wire. He is survived by his parents, and had no wife or children. The parents sued the electric cooperative, alleging negligent installation of the guy wire. A jury awarded plaintiffs $3 million for the mental pain and anguish suffered by the parents for the loss of their adult son.

Other Bad Faith & Coverage Settlements.

$3.0 million on a $25,000 policy.

$650,000 on a $25,000 policy.

$3.0 million policy limits paid after contested coverage denial.

$1.8 million paid on a $1.0 million policy.
